Decent Exposure

The City of Kennedale, which got a lot of press for its “decency drive” to banish sexually oriented businesses (SOBs) from land that it annexed, was handed a defeat a few days ago. U.S. District Judge Terry Means granted the Dreamers adult video store a permanent injunction from enforcement of Kennedale’s restrictive SOB ordinance. Fort Worth attorney Mike Ware, who represented Dreamers, said the case is a victory for free speech. “Kennedale was unlawfully abridging the First Amendment when it tried to run out the SOBs,” he said.
Kennedale City Attorney Wayne Olson plans to ask the judge to reconsider the ruling and will talk to the city council about whether it wishes to appeal. He also pointed out that the news wasn’t all bad this week for the Kennedale side: At least one X-rated video store there has agreed to close.
